In joining this membership, Member acquires interest in the herds and livestock as required by law, and the food products (as available) produced from livestock, farm & ranch. This farm membership and livestock-corral lease agreement is entered into between the member, Association and Rainbow Ranch Farms (hereinafter, the association/Farm & Ranch).

Through the interest in the lease agreement, Member is entitled to other fresh sustainably-grown farm products from the Farm when they are available and a service fee is paid before custom services are rendered, as required by law. By signing below, Member agrees to the following: Pages of 10 sections.

1. PERSONAL USE
Custom processed meat products (beef, pork, goat and lamb) received will be for personal use only and shall not be sold and shall not be distributed to anyone outside Member's family and/or guests. If you are reselling to the general public you agree to notify farm or ranch to get U.S.D.A approved processing services.

2. EDUCATION
Member understands and acknowledges that meats NOT sprayed or bathed with antimicrobials, bleach and/or salt may contain harmful pathogens and that consumption is not recommended by the Centers for Disease Control (CDC), the Food and Drug Administration (FDA), the United States Department Of Food and Agriculture (USDA), and/or the State Department of Agriculture and/or the Department of Public Health.

Member agrees to educate Member's family about the risks associated with the consumption of custom processed meats and with the improper handling and storage of custom processed meats.

3. RISKS
Member acknowledges that there are or may be risks of harm encountered in visiting or entering the Farm or any other premises where the leased herds, flocks and livestock are located, including but not limited to visiting and/or interacting with the herds, flocks, livestock and/or other animals that may be found in the vicinity of the farm.

Member hereby knowingly accepts and demands to assume the risk of any and all such harm and also hereby waives any and all right to make, file, or pursue any claims, liability, demands, suits, actions, causes of action, and or damages, including, but not limited to financial damages against Rainbow Ranch Farms, Farm members, volunteers, participants and the Association and/or any of its members, agents, employees, representatives, principals, lessors, lessees, vendors, contractors and/or subcontractors, that arise out of, or in any way relate to any injury, illness, death, loss or damage caused, in whole or in part, by any of the following:

(a) The handling or consumption of custom processed meats and exempt poultry products obtained from Rainbow Ranch Farms, farm members and the Association or the Farm,

(b) Visiting or entering the farm or any premises where the leased herds, flocks and/or livestock are located,

(c) The care and/or boarding of the leased herds, flocks and/or livestock.

4. WAIVER OF CLAIMS
Waiver of claims, against Rainbow Ranch Farms, Kelley Beef, Members and the Association: Waiver of Claims against the Farm: Member waives any and all right to make, file, or pursue any claims, demands, suits, actions, causes of action, liability and/or any and all damages, against the Farm and/or any of its owners, agents, members, volunteers, employees, representatives, principals, lessors, lessees, vendors, contractors, subcontractors, etc. that arise out of or in any way relate to any injury, illness, death, loss or damage caused, in whole or in part, by

(a) The handling or consumption of custom processed meat products and/or any other food obtained from Rainbow ranch farms, farm members and the Association or the Farm,

(b) Visiting or entering the Farm or any premises where the leased herds, flocks and/or livestock are located,

(c) The care and/or boarding of the leased herds, flocks and/or livestock.

5. INDEMNITY - ASSOCIATION
Member shall indemnify and defend Rainbow Ranch Farms, Farm members and the Association and its members and shall hold harmless Rainbow Ranch Farms, Farm Members, the Association and its members, volunteers, members, agents, employees, representatives, principals, lessors, lessees, vendors, contractors, subcontractors, etc. against any and all demands, claims, damages, liability, suits, actions and/or causes of action, . For any injury, illness, death, loss or damage that arises out of, or relate in any way to

(a) Any handling, processing, and consumption offered and/or serviced by the association and/or farm, after it has been received or otherwise obtained by the Member,

(b) The visit by any person that Member brings to, or causes to visit the Farm or any premises where the leased herds, flocks and/or livestock are located.

6. INDEMNITY - FARM/FARMS/RANCH
Member shall indemnify and defend Rainbow Ranch farms, Farm members and its owners and shall hold harmless the Farm and/or the association and its owners, agents, employees, representatives, farm members, volunteers, principals, lessors, lessees, vendors, contractors, and/or subcontractors, against any and all demands, liability, claims, suits, actions, causes of action, etc. for any injury, illness, death, loss or damage that arises out of or relate in any way to

(a) Any handling, processing, consumption, or use of any exempt poultry, custom processed meats after custom meat and/or exempt poultry has been received or otherwise obtained by the Member,

(b) The visit by any person that Member brings to, or causes to visit the Farm or any premises where the leased herds, flocks and/or livestock are located.

7. ENTRAPMENT
Member attests and affirms that he/she is not an agent for any federal, state, or local government agency/agencies trying to, or attempting to, entrap, investigate, prosecute, bring charge or persecute Rainbow Ranch Farms, Stavrinides Rainbow Farms, farm and/or property owners, volunteers, farm operation, farm members, participants, the farm and/or their owners.

7.5 WHOLESALE BUYING CLUB & CO-OP
As a farm member all additional and related wholesale co-op products, NOT produced by Rainbow Ranch Farms can be purchased at wholesale prices. Products will be from C.D.F.A. verified and U.S.D.A. inspected sources as required by law, and offered to the group of members at wholesale prices.

As a farm member, C.S.A. member and wholesale buying club member, I understand and agree that I will have access to these products. I understand that custom processed meats (cattle, beef, hogs, pork, sheep, lamb, and goat) can only be made available to farm members, who own the livestock prior to harvest.

I understand that all C.S.A. products are grown, produced and harvested by Rainbow Ranch Farms, including, but not limited to its members and volunteers on the farm. I understand that wholesale buying club and co-op products may be grown, produced and harvested by farmers and artisans and products may be C.D.F.A. verified and/or U.S.D.A. inspected as required by law.

8. SEVERABILITY
If, for any reason, any provision or provisions of this agreement are determined to be invalid and/or contrary to any existing or future law, such invalidity shall not impair the operation or affect those portions of this agreement which are valid.

9. CAPTIONS
The captions of sections and subsections contained in this agreement are for convenience only and shall not control or affect the meaning or construction of any of the provisions of this agreement

9.5 LEASE & LEGAL RETAINER
1. This agreement includes the shared lease of the area, chute and/or corral where the custom processing/harvesting occurs.

I understand that a portion of my membership fee is applied to the lease of the areas where the livestock are harvested. I understand that a portion of my annual farm membership fee is applied to all livestock that I, partially own prior to the custom harvest.

2. I understand, portions of member dues go toward securing annual retainer of Farm-To-Consumer Legal Defense Fund.

10. MEMBER AGREES AND FULLY UNDERSTANDS
I agree and fully understand that Rainbow Ranch Farms provide a valuable service to and for private members only. I understand that custom processed meats are not U.S.D.A. Inspected, and that they can be upon request and can also be processed at a California State Licensed facility, upon request. I understand that custom processed meats which are not sprayed with anti-microbial are not recommended by the F.D.A., U.S.D.A. or the C.D.F.A.

NON-DISCLOSURE
Member shall never discuss, share, imply or disclose (via, text, verbal, written, typed, spoken or by sign or related modes of communication) any proprietary farm formulas, such as herbal, sanitary cleaning recipes, organic livestock feed recipes, growing and brooding methods including, but not limited to harvesting methods.

As a Member I will respect the privacy and protect all proprietary farming methods, techniques, and recipes used by rainbow ranch farms.

I (Farm Member) have read this farm agreement in full, agree and understand it in full. I have decided that this is right for me and my family and demand to join as a farm member, for myself, my spouse, partner and my family and guests. I accept full responsibility for my decision and my signature, membership dues and date, makes this a legally binding contract.

I agree that my membership dues are NON-REFUNDABLE, and dues are due every 12 months. If yearly dues are not submitted, membership will be mutually, considered cancelled.

Any dispute or breach to this agreement will be filed with Superior Courts, within the San Bernardino County, in the State of California.
